The following terms and conditions shall apply by Norfolk China Ltd unless expressly varied in writing.

1. Customers who have no ledger account open with Norfolk China Ltd will be on pro-forma invoice terms until a credit account has been established and are respectfully requested to send their remittance with order to avoid delay in despatching the goods. If a credit account is desired, bank and two trade references should be forwarded and a few days allowed for necessary enquiries to be made. All accounts are to be paid to Norfolk China Ltd, Horsbeck Way, Horsford, Norwich, Norfolk, NR10 3SS. Payment is due strictly 30 days from date of invoice.

2. Due to Carriers conditions, claims for damage, defect or short delivery must be reported within 7 days to Norfolk China Ltd and conformed in writing. Claims for non-delivery must be reported to Norfolk China Ltd within 14 days of the date of invoice. Time being of the essence.

3. Until Norfolk China Ltd have received payment in full for the goods comprised in any Contract of Sale, the goods will remain their property, although the risk therein passes to the Purchaser at the point of delivery.
Norfolk China Ltd may recover the goods and for that purpose, they and their Agents are hereby expressly authorised by the Buyer to enter upon any land or building where the goods may be stored.

4. Notwithstanding that payment for such goods is not otherwise due under these conditions of sale such payment shall become immediately due upon the commencement of any act or proceeding which the intending purchaser’s solvency is involved.

5. Unless otherwise provided, payment shall be made within 30 days from date of invoice. In the event of any sum remaining unpaid for a period in excess of 2 months from the date of invoice, Norfolk China Ltd may charge 15% of the unpaid sum for each month, or part month which it remains unpaid, without prejudice to their right to take action for recovery, or for breach of contract.

6. The minimum value for each order shall be no less than £100 (One Hundred Pounds Sterling). Norfolk China ltd will pay all carriage charges on all U.K. orders with a value of £300 and over with the exception of the Highlands and Islands of Scotland and Northern Ireland which will be charged a Carriage Surcharge depending of weight of order. All exported orders will have carriage costs quoted separately.

7. Norfolk China Ltd reserves the absolute right at any time to alter any of the selling prices and to alter the terms which allows to any customer without any notice whatsoever and in respect of goods delivered after such change of price or terms, the price charged shall be the price current at the date of despatch of the goods and terms applicable shall be the terms so varied.

8. VAT will be charged on all orders within the United Kingdom at the current U.K. rate.

9. All contracts shall be governed and construed according to the laws of England and any dispute arising out of or in connection with the same shall be submitted to the exclusive Jurisdiction of the English Courts.
